Membership Terms and Conditions - Constitution
- A) Criteria for Membership Application
- 1) Applicants must have either
- 1a) a Bachelor of Arts Degree (or similar Higher Education qualification) in Scenography/Theatre Design/Performance Art (or similar Art or Performance course) from a college/school/university recognised by the government/authority of the country where the college/school/university is located.
- (or)
- 1b) Evidence of paid professional work experience in the performance or arts industries.
- 2) In order to authorise your membership, we need to know certain personal information, this information is stored as defined in our Privacy Policy (I)
- 3) Application is open to individuals only
- B) Member Portfolio Pages
- 1) Membership is subject to our application criteria.
- 2) The Administrator and his/her agents reserve the right to decline applications.
- 3) The Administrator and his/her agents reserve the right to edit, modify and remove member pages, images, text and content without prior notice.
- 4) The Administrator and his/her agents reserve the right to terminate your account without prior notice.
- 5) You hereby declare that you will not promote commercial companies, organisations, individuals or products that are not related to the theatre or arts industries.
- 6) You hereby declare that you will not embed/insert affiliate links of any kind into your portfolio pages.
- 7) You hereby agree not to publish images depicting or containing nudity without the prior consent of the administrator.
- 8) You hereby agree not to publish abusive, obscene, libellous, hateful, threatening or any other material that may violate any applicable laws.
- 9) You hereby agree that any information required for the activation of your account (Full Name, Address, Email Address, Qualifications, Details of Professional Work etc.) Are accurate and up to date.
- 10) Your hereby consent to the publication of your name, town/city and country of your residence.
- 11) Your Telephone/Mobile/Cell Number are not required but will be published if you submit them.
- C) Email
- 1) The Administrator and his/her authorised representatives reserve the right to terminate your email account without prior notice.
- 2) You hereby agree not to use your email account to send abusive, obscene, libellous, hateful, threatening or any other material that may violate any applicable laws.
- 3) You hereby agree to comply with our hourly sending limits of 150 emails per hour.
- 4) You hereby agree not to use your email account for the sending of unsolicited bulk email.
- 5) You hereby agree to send the Scenography - Theatre Design Website member signature and legal disclaimer on all of your out-going email.
- D) Copyright
- 1) You hereby agree that all content published on your pages (such as text, images or other intellectual property) has either been cleared for such use by you the copyright holder.
- E) Disclaimer
- 1) In no event will the Administrator or the Online Society of Theatre Designers and Scenographers be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use this website or any content thereon. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract, tort, or otherwise, caused by any failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmission; computer virus; file corruption; communication line failure; network or system outage; or theft, destruction, unauthorized access to, alteration of, or use of any record.
- F) Support and Service
- 1) The Online Society of Theatre Designers and Scenographers will provide free portfolio pages and email services you subject to your agreeing this constitution.
- 2a) Server Side Support Issues - The Administrator and his/her authorised representatives will endeavour to provide support to all issues relating to the server side operation of Scenography - The Theatre Design Website, its member portfolio pages, and email accounts in a timely and consistent fashion.
- 2b) Member Side Support Issues - The Administrator and his/her agents may only offer advice in regards to support issues that are related to Internet Connection, Email setup on your computer, and login issues that relate to the settings of your computer.
- 3) The Administrator and the Online Society of Theatre Designers and Scenographers will endeavour to keep the Scenography - Theatre Design Website in good working order and to ensure so far as is practicable that it meets the W3C recommended web standards.
- G) Administrator
- 1) The Administrator has the delegated authority to act on the Society’s behalf in all matters relating to the funding, promotion and administration of the Scenography - The Theatre Design Website and the Online Society of Theatre Designers and Scenographers.
- 2) In the event that the Administrator wishes to relinquish his/her authority, he/she will either nominate his/her replacement or authorise a representative to elect a new Administrator.
- 3) In the event that the Administrator should be unable to do so his/herself the Administrator has nominated two individuals who will elect a replacement.
- 4) The Administrator or the Society Treasurer shall be responsible for maintaining a Bank Account on behalf of the Society and shall on request, make account statements available to any member.
- 5) The society shall re-imburse the Administrator/Treasurer all reasonable expenses incurred in the course of his/her duties for the Society.
- I) Privacy Policy
- 1) The Online Society of Theatre Designers and Scenographers is committed to safeguarding the privacy of it’s members and users.
- 2) It is our policy that any information given to us by you is private and confidential. Accordingly, the personal information you provide to us is stored in a secure location, and is accessible only by designated members of the society. It will be used only for the purposes for which you provide the information. We will not sell, rent or trade any personal information you provide to us. This information may be used for any correspondence with members/users including support calls and emails.
- 3) Our computers are not set up to track, collect or distribute personal information about our visitors. They recognize the home server of visitors, but not e-mail addresses. For example, we can tell which Internet Service Provider our visitors use, but not the names, addresses or other information about our visitors that would allow us to identify the particular visitors to our site. In addition, our web site tracks information about the visits to our web site. For example, we compile statistics that show the daily number of visitors to our site, the daily requests we receive for particular files on our web site, and what countries those requests come from. These aggregated statistics are used internally to better provide services to the public, but again, the statistics contain no personal information and cannot be used to gather such information.
- 4) We will not pass any of your information to any third parties unless you have given prior permission to do so and we will email you periodically about new services and related theatre and performance news.
- 5) Please keep in mind that whenever you voluntarily disclose personal information on-line in guest books, message boards, through email, in chat, by entering contests, posting a contact reference on your portfolio, etc. - that information can be collected and used by others. In short, if you post personal information on-line that is accessible to the public, you may receive unsolicited messages that are completely beyond our control and responsibility.
- 7)Ultimately, members are solely responsible for their actions when on-line, and for keeping their passwords, and all other personal information private.
- J) Agreement
- 1) Membership to the Portfolio pages and the Online Society of Theatre Designers and Scenographers is dependent on your agreeing to the terms and conditions laid out in this document. By clicking the “Apply†button you agree to comply with the conditions in the Societies constitution and Terms and Conditions of membership.
- 2) Failure to comply with the above conditions may result in the termination of your portfolio pages and email account.
- 3) The Treasurer agrees to honour his/her commitments as laid out in this document.
- 4) The Administrator agrees to honour his/her commitments as laid out in this document.
